3. Your Account

To use certain features of the Service, you must create an account. You are responsible for safeguarding your account and for all activities that occur under your account. You agree to:

• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, false, or outdated.

4. Service Credits

Our Service operates on a credit-based system. Credits are consumed when you optimize images using our Service.

• New users receive 50 free credits upon account creation
• Additional credits can be purchased through our platform
• Each image optimization consumes one credit
• Credits are non-refundable and non-transferable
• Unused credits do not expire

5. Payments

All payments are processed securely through Stripe. By making a purchase, you agree to provide current, complete, and accurate purchase information. We reserve the right to change our prices at any time.

6. User Content

Our Service allows you to upload, store, and process images ("User Content"). You retain all rights to your User Content. By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process that content solely for the purpose of providing and improving the Service.

You are solely responsible for your User Content and the consequences of uploading it. You represent and warrant that:

• You own or have the necessary rights to use and authorize us to use your User Content
• Your User Content does not violate any third party's intellectual property rights, privacy rights, or other rights
• Your User Content complies with these Terms and all applicable laws and regulations

7. Prohibited Uses

You agree not to use the Service:

• To upload, transmit, or distribute any content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
• To impersonate any person or entity or misrepresent your affiliation with a person or entity
• To engage in any activity that interferes with or disrupts the Service
• To attempt to gain unauthorized access to the Service, other accounts, or computer systems
• To upload or transmit viruses, malware, or other malicious code
• To circumvent any technology we use to protect the Service
• To scrape, crawl, or spider any page, data, or portion of the Service
• To use the Service for any illegal purpose

8. Service Limitations and Modifications

We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Technical limitations:

• Maximum file size: 10MB per image
• Supported file formats: JPG, JPEG, PNG, WebP, and GIF
• Maximum number of simultaneous uploads: 50

9. Intellectual Property

The Service and its original content, features, and functionality are owned by ImageSkunk and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

10. Limitation of Liability

To the maximum extent permitted by law, in no event shall ImageSkunk, its affiliates, or their respective directors, employees, or agents be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to your use of, or inability to use, the Service.

11. Indemnification

You agree to defend, indemnify, and hold harmless ImageSkunk, its affiliates, and their respective directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from or related to your use of the Service or violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notification of material changes by posting a notice on our website. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
